Tim Boland proved a godsend when my aging father was T-boned at an intersection on the outskirts of town while showing houses to some real estate clients. He suffered serious damage to his hip and shoulder which absorbed the brunt of the impact, requiring extensive reconstructive surgery. Despite his years, my dad still enjoyed an active lifestyle, playing squash and swimming on a regular basis, engaging in various physical activities with his grandchildren, and selling real estate.Needless to say, his lifestyle and livelihood came to an abrupt end that day. The physical injuries were exacerbated by the fact that the police charged him with failing to stop, following a perfunctory investigation that entailed simply speaking to the other driver—as my father and his passengers were being conveyed to the hospital. My father insisted that he had come to a complete stop, and had looked both ways, before entering the intersection to cross the secondary highway—and that the other vehicle had seemingly come speeding out of nowhere. Despite his claims, it looked like an impossible case to try and recover any compensation for my father’s pain and suffering, and loss of income. We watched as the police investigators and the other driver squirmed under Tim’s rigorous cross examination, exposing the rush to judgement, and revelations such as the other motorist and his van load of revelers, from out of town, were on their way to wedding, that they had absolutely no chance of making on time---had they been travelling at the speed limit. Despite running late, they had opted to stop and load up at the Beer Store—just moments before the collision. It was obvious to everyone that the van was travelling well above the speed limit. The court took no time to deliberate in acquitting my father—but not before castigating the police for their tunnel vision and slipshod investigation.From there Tim marshalled additional evidence in support of my father’s claim, including, interviewing other witnesses, requisitioning engineering reports, and securing MTO records, which evidence established that the curve in the secondary highway, consequent sightlines, prevailing speed limit, absence of signage, etc., all conspired to make that intersection, rather perilous. Indeed, there had been somewhat of a pattern of similar collisions at that location.Tim’s superb skills as a litigator were again evident as he successfully sued the municipality, and the other driver over the injuries my father sustained. We were delighted when he secured a surprisingly generous settlement offer on behalf of my father, no doubt in large measure due to his reputation for pursuing deserving claims on behalf of clients, even when they may present somewhat of a challenge to other litigators.
