I worked for this company for about 3 months. I was terminated by management, for submitting a formally written complaint about a toxic co-worker, as well as for offering suggestions on how I thought management could be improved. Management told me that my complaint was too extreme, that I was not happy working, and that I did not have the right to offer my ideas. I have since filed complaints to WorkSafeBC and Employment Standards Branch. Both organizations opened a file for me regarding prohibited actions. From WSBC, in a communication report from a prevention officer, my employer stated that I was terminated due to performance issues, even though I was never issued any warnings. In fact, I was given a raise one week prior to termination, and I was praised for my work. Mediation proved futile. WSBC and I waited nearly 42 days for my employer’s optionally requested information for adjudication. My employer chose to respond, but they had to lie in doing so, because they had to forge a termination letter, one which I never received. According to my advisor, my complaint will not meet the threshold, so I am essentially waiting for that file to be closed. To make matters even worse, WorkBC cannot help me find employment until my file with WSBC is closed. As for ESB: I spoke with an investigator, and he said that my complaint would not meet their threshold either. He did say, however, that I should proceed with Human Rights and Civil Revolution Tribunal.
